Welcome to Jarify! These Terms of Service ("Terms") govern your access to and use of the Jarify website, mobile application, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE SERVICE.

1. Acceptance of Terms

By creating an account or using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Eligibility

You must be at least 13 years old (or 16 in the European Economic Area) to use the Service. By using the Service, you represent and warrant that you meet this age requirement.

If you are under 18 years old, you must have permission from a parent or legal guardian to use the Service.

3. Description of the Service

Jarify is a task management and productivity application available on iOS and Android. The Service allows you to:

• Create, organize, and complete tasks using categories
• Track your productivity through a gamified jar-filling experience
• Archive and review completed jars and their tasks
• Connect with friends to share progress
• Sync your data across devices via cloud storage

The Service includes both free and premium features. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

4. Account Registration

To use the Service, you must create an account. You agree to:

• Provide accurate, current, and complete account information
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Acceptable Use

You agree NOT to use the Service to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others, including intellectual property rights
• Transmit harmful code, viruses, or malicious software
• Harass, abuse, or harm other users
• Spam, distribute unsolicited content, or engage in phishing
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the Service or its servers
• Use automated tools (bots, scrapers) without our permission
• Impersonate any person or entity
• Collect personal information from other users without consent

6. User Content

You may create content through the Service, including tasks, categories, jar labels, and other data ("User Content"). You retain all ownership rights to your User Content.

6.1 License to Jarify

By submitting User Content, you grant Jarify a worldwide, non-exclusive, royalty-free license to use, store, display, and process your User Content solely for the purpose of providing and improving the Service.

6.2 Responsibility for User Content

You are solely responsible for your User Content. You represent and warrant that:

• You own or have the necessary rights to your User Content
• Your User Content does not violate any laws or third-party rights
• Your User Content does not contain harmful, offensive, or illegal material

6.3 Content Removal

We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable, without notice.

7. Intellectual Property

The Service, including all content, features, and functionality (excluding User Content), is owned by Jarify and is protected by international copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Service without our express written permission.

8. Subscriptions and Payments

Jarify offers both free and premium subscription plans. If you choose to subscribe to a premium plan:

• You agree to pay all applicable fees as displayed at the time of purchase
• Subscriptions are processed through the Apple App Store or Google Play Store and are subject to their respective terms and refund policies
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period
• You can manage or cancel your subscription through your device's app store settings
• We reserve the right to change pricing with 30 days' notice

9. Disclaimers and Limitation of Liability

9.1 "As Is" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 No Guarantee of Availability

We do not guarantee that the Service will be uninterrupted, secure, or error-free. We may suspend or terminate the Service at any time for maintenance, updates, or other reasons.

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JARIFY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION ARISING OUT OF YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, OR $100, WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless Jarify, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your User Content
• Your violation of these Terms
• Your violation of any third-party rights

11. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, for any reason including:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Extended periods of inactivity

You may delete your account at any time from the Settings screen within the app, or by contacting us at support@jarify.app. Upon account deletion, all your data will be permanently removed as described in our Privacy Policy.

Upon termination by us, your right to use the Service will immediately cease. Some information may be retained as required by law.

12. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

• Update the "Last Updated" date at the top of this page
• Notify you via email or through a notice in the app
• Provide at least 14 days' notice before changes take effect

Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service.

13. Dispute Resolution

13.1 Informal Resolution

Before filing a legal claim, you agree to attempt to resolve disputes informally by contacting us at support@jarify.app. We will work with you in good faith to resolve the issue.

13.2 Arbitration (where permitted)

If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules, except where prohibited by law (e.g., in the EU where consumers have the right to go to court).

13.3 Class Action Waiver

To the extent permitted by law, you agree that disputes will be resolved on an individual basis and not as part of a class action or consolidated proceeding.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the European Union and the jurisdiction where Jarify is established, without regard to conflict of law principles.

If you are a consumer in the EU, you retain the protection of mandatory consumer protection laws in your country of residence.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Jarify regarding the Service and supersede any prior agreements.
